These Terms of Service govern use of My Speak and its learning features.

1. Acceptance of Terms
These Terms of Service govern your use of My Speak, including its website, app, English courses, AI conversations, Live Coach, Podcast, pronunciation practice, Interview Coach, referrals, and other features. By creating an account, accessing, or using the service after accepting these Terms, you agree to them and the Privacy Policy. My Speak is currently operated by an individual owner / sole proprietor.
2. Eligibility
You must be at least 13 years old to create or use an account. Users ages 13–17 should use My Speak only with permission from a parent or legal guardian. The service may be offered internationally where legally permitted, and you may use it only where it is made available to you.
3. Accounts and Security
Provide accurate account information and keep your sign-in details secure. Do not share credentials. Tell us promptly about suspected unauthorized use. One person may not create multiple accounts to commit fraud, abuse referrals or payments, or bypass a plan limit.
4. Purpose and Availability
My Speak is an AI-assisted English-learning and communication-practice service. Features, courses, limits, and languages may differ by plan, region, platform, account status, or release stage. Features may be unavailable, delayed, interrupted, modified, or discontinued because of maintenance, network problems, provider outages, technical failures, or security needs.
5. AI-Generated Content
Parts of the service use artificial intelligence. AI may misunderstand you, transcribe speech inaccurately, provide incomplete or unnatural wording, or produce irrelevant or inappropriate suggestions. Review AI output and use your judgment. We do not guarantee that every AI response is accurate, complete, or appropriate.
6. Learning Results
My Speak provides education and practice. It does not guarantee fluency, exam results, employment, interview success, pronunciation improvement, or advancement to a particular language level. Results depend on effort, usage, prior knowledge, and individual circumstances.
7. Voice Features and Live Coach
Voice features, including Live Coach, may use microphone input, speech detection, transcription, AI interpretation, generated coaching responses, and text-to-speech. The service may mishear or misunderstand speech. Microphone permission is controlled by your device or browser and can be revoked. Live Coach is not an emergency service, professional advisor, or replacement for qualified human assistance.
8. Podcast, Courses, and Interview Coach
Podcast content may be AI-generated, personalized, automatically selected, or based on topics you choose. It may occasionally repeat, contain errors, or not match your preferences. Courses, including are educational content; released courses may be selected independently and recommendations do not guarantee outcomes. Interview Coach helps you practice communication and does not guarantee a job, offer, hiring, or resume acceptance. Review answers and keep information provided to employers truthful; do not invent experience, education, certifications, skills, accomplishments, or licenses.
9. User Content and Uploads
You retain ownership of your original text, voice, prompts, documents, profile information, feedback, and topic requests. You give My Speak only the limited rights needed to process, host, transmit, analyze, or transform that content to operate and improve the service, consistent with the Privacy Policy and your settings. Upload only material you have the right to use and avoid unnecessary highly sensitive information.
10. Acceptable Use
Do not use My Speak for unlawful activity, fraud, impersonation, harassment, misuse of another person's information, payment abuse, referral manipulation, automated scraping, unauthorized access, attacks, service disruption, or reverse engineering where legally enforceable. Do not use the service to create deceptive employment credentials or bypass plan limits.
11. Paid Features and Limits
Prices, billing periods, renewals, feature or minute limits, and plan changes are disclosed during checkout or in the applicable plan rules. Free and paid accounts may have AI-generation, voice-minute, feature, or course availability limits that reset according to those rules. Paid subscriptions renew automatically until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current paid billing period. We do not provide prorated refunds for unused time except where required by applicable law or where My Speak determines that a billing error occurred. Any refund, cancellation, or consumer right required by applicable law will be honored.
12. Referrals and Payouts
Referral Program Terms apply separately when you activate referrals. Referral earnings can be pending and are not guaranteed payouts; refunds, chargebacks, fraud, duplicate accounts, self-referrals, or ineligible transactions may result in an adjustment. Referral Payout Terms apply separately before a first payout request.
13. Suspension and Termination
We may restrict or terminate access when reasonably necessary for fraud, security risk, abuse, prohibited use, payment or referral manipulation, legal requirements, or protection of the service and its users. Contact support at kmztgi@gmail.com if you need to ask about an account action.
14. Disclaimers and Liability
The service is provided for learning and practice and is not guaranteed to be uninterrupted or error-free. To the maximum extent permitted by law, My Speak is provided without additional guarantees and liability is limited to the extent permitted by applicable law. Before filing a formal claim, you and My Speak should first attempt to resolve the issue through good-faith written communication. Any unresolved dispute may be brought in a court of competent jurisdiction as permitted by applicable law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. No mandatory arbitration or class-action waiver is adopted at this time.
15. Changes
We may update these Terms or the Privacy Policy. Material changes may require notice and a new version acceptance; minor formatting or clarification changes may not. Current versions and update dates are shown with the documents.
